ADB Insights is launching the Ontario Estates Forum in October, 2020, the second in a national series. The forum will be held virtually on Whova - a virtual event platform. By being virtual, it offers speakers and participants a unique and engaging way to connect with the broader estate planning ecosystem in an innovative format.

Ontario is unique. It has a rapidly expanding population, is on the edge of the largest intergenerational transfer of wealth in history and it has a large number of high-net-worth individuals and families based in - and relocating to - the province. This leads to both opportunities and challenges when it comes to estate planning, management and execution. 

The purpose of the Ontario Estates Forum is to shine a light on the key contexts, drivers, challenges and opportunities for professional advisors in the province’s estate planning ecosystem. In light of the economic and social impact from COVID-19, it will present a picture of what it means for assets and businesses underpinning individual estates and for the advisors involved with managing them. The evolving role of innovation in the estates ecosystem - another key driver - will also be covered. And - finally - the forum will provide an opportunity for members of the estate planning ecosystem to engage with each other.

  • Online Forum over 2 afternoons - October 21st, 22nd between 1-5pm, hosted on Whova, a virtual events platform.

  • 8 x sessions (panel discussion format) of 50 minutes each, 3-4 speakers per panel

  • Presentations from subject matter experts on areas related to the key themes of the forum.

The planning and transfer of estates is an increasingly complex process, with a number of key drivers at play. These include a massive generational transfer of wealth, a large number of high value estates in Ontario and more complex estates (including complex corporate structures, assets held internationally and families based in multiple jurisdictions). The impact of COVID-19 on the provincial, national and the global economy and society is also affecting the estate planning process. In our opening panel, our presenters will analyze the context and key drivers when it comes to the estate process: coordination, planning and execution.

Digitization and wills: a new paradigm emerges. (2:05-3:05 PM)
The impact of COVID-19 has been significant for the estate planning sector and a core area of focus has been on electronic wills. In April, Ontario became the first Canadian jurisdiction to allow virtual witnessing of wills under its emergency order. Other provinces and jurisdictions have followed suit. Beyond virtual witnessing, multiple innovations are emerging as key drivers of change for electronic wills. These include tools that enable the online creation of wills by both consumers and their advisors well as digital repositories to register, store and search them. Here, our speakers will review the key trends, opportunities and challenges when it comes to wills and digitization.

The role of wealth managers in estate planning - specifically in terms of how assets are managed, grown and ultimately transferred - is evolving. Wealth managers are no longer just focused on investing, they also are playing an increasingly central role when it comes to managing all facets of the estate planning process (including distributing work to other professionals). Technology is another driver of change - with new platforms emerging to better support wealth managers’ workflows as well as the rise of more disruptive forces such as robo advisors. In this session, our panelists will review this evolution of the wealth manager’s role, the tools available to them and what it means for the estate planning ecosystem.

Litigation, regulation and estate planning. (4:15 -5:15 PM)
From a legal perspective, litigation and regulation are key considerations when it comes to estate planning. An estate ending in litigation is a common issue faced in the succession and estate distribution process. In terms of regulation, the Succession Law Reform Act provides the core legal context for estate planning and transfer in Ontario. Here, our panel will review what litigators look for when an estate litigation file comes to them, the common issues and solutions that arise in estate litigation and the areas that other professionals in the estate planning ecosystem should be aware of to best advise their clients (and protect the ultimate beneficiaries of estates).  And they will review key areas professionals should be aware of when it comes to the Succession Law Reform Act.
